Terms of Service
Please read these Terms of Service carefully before using the services provided by Bavivi AG, Pfingstweidstrasse 98, 8005 Zürich, Switzerland (hereinafter "Bavivi"). These Terms govern your use of our website and any housing services or communications offered by Bavivi AG.

1. Scope and Applicability
These Terms apply to all visitors and prospective or current tenants ("users") who use our website or engage with Bavivi AG in connection with residential rental properties. By accessing our services or entering into a rental agreement with Bavivi AG, you agree to be bound by these Terms.

2. Application and Tenancy
Housing offered by Bavivi AG is available upon successful application and subject to a signed lease agreement. To apply for a residential unit, users must:

  • Be at least 18 years old

  • Provide accurate personal and financial information

  • Agree to comply with our house rules and values of respectful, community-based living

The final decision on tenancy remains at Bavivi’s discretion. The lease begins and ends according to the terms specified in the signed agreement.

3. Tenant Responsibilities
Tenants are expected to:

  • Use the rented unit exclusively for residential purposes

  • Follow house rules and community guidelines

  • Refrain from subletting without prior written permission

  • Maintain cleanliness and proper use of shared spaces

Failure to comply may result in early termination of the lease, in accordance with Swiss tenancy law.

4. Platform Use and Communication
Bavivi offers a digital onboarding and communication system to streamline the tenant experience. While our platform does not act as a public forum or content-sharing space, tenants may receive updates, documents, and support through our digital systems or app.

5. Privacy and Data Protection
Bavivi AG processes personal data in compliance with the Swiss Federal Act on Data Protection (FADP) and the General Data Protection Regulation (GDPR) where applicable. For more information, refer to our Privacy Policy.

6. Payment Terms
Before the handover of keys and the start of the rental period, tenants are required to pay:

  • The first month’s rent in full

  • A security deposit, which is held in accordance with Swiss tenancy law

The deposit serves as financial security for potential damages or unpaid rent and will be returned after the end of the tenancy, subject to inspection and deduction of any outstanding costs. No handover will take place until both payments have been received in full.

7. Limitation of Liability
Bavivi AG is not liable for any indirect or consequential damages arising from the use of its website or services, unless caused by gross negligence or intent. Liability for damages to life, body, or health remains unaffected by this limitation.

8. Governing Law
These Terms and all rental agreements are governed by Swiss law. The place of jurisdiction for any disputes is Zurich, Switzerland, unless otherwise agreed.

9. Changes to Terms
Bavivi AG reserves the right to update these Terms at any time. Continued use of our services constitutes acceptance of any revised terms.
